Select Nannies provides Permanent & Casual babysitters/nannies/mothers helpers/au pairs/ party helpers as per the terms contained in this agreement:
- Contract
These terms and conditions shall represent a legally binding contract between you (the “client”) and Select Nannies ABN 24 361 755 453 (the “Agency”). The verbal or written instruction by the client to the Agency to submit suitable Candidates/Employees/Carers for interview shall constitute acceptance of these terms and conditions. The term “candidate/Employee/Carer” means a person introduced by the Agency.
- Acceptance
By submitting the Parent Application form and providing us with your information, you agree to all of the “agency’s” Terms set forth in this document. If you do not agree to these terms, you are not granted the permission to use this site or any of the services or products provided and please do not use our site. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms at any time. Your use of this website means that you accept any changes that are made to these Terms and Conditions.
- Client' Obligations
The Client must supply any information required by Select Nannies to provide the Services in a clear and unambiguous manner and inform Select Nannies of any updates. You are required to complete a Parent Application Form. You must provide details to our nannies if there are any restraining orders in place or custody disputes to ensure the safety of your children full details including a description of the person or persons against whom the restraining order has been made. You agree to provide a clean, safe and secure working environment.
- Confidential Information
All communication, whether written or oral and however communicated, shall be confidential between the parties. Should the Client pass on any information including, details of the Candidate, or recommend a Candidate to a third party resulting in a booking of employment then the Client will be liable for the Agency booking fee and Placement fee as if the booking had been made by the Client itself and these terms and conditions shall apply accordingly.
All correspondence and records shall be confidential and remain the property of the agency. Information supplied by the agency is confidential and is accepted by the client on the condition that such information will not be disclosed to third parties.
- Introduction by Third Parties
It is the obligation of the Client to immediately inform the Agency when a Candidate is introduced by the Agency and also by a third party. If the client does not inform the Agency then it will be presumed that the introduction has been effected by the Agency and the relevant fee will become payable.
- Limitation of Liability
The Agency endeavours to provide the Client with only the most suitable Candidates and verify their credentials, qualifications and references. These are also made available to Clients in confidence for them to check the references. However the final decision to employ the services of the Candidate is the sole responsibility of the Client and the Agency does not accept any liability for any kind of inconvenience, loss or damage howsoever arising and whether caused directly or indirectly from an act or omission of a Candidate introduced by the Agency. Similarly no warranty is offered in respect of the suitability, honesty, capability or character of any Candidate introduced by the Agency and employed by the Client.
Select Nannies accepts NO LIABILITY for this agency, its staff or applicants for any damage, compensation, loss or any other claim resulting from the employment of the Au Pair or Nanny either live in or live out, introduced or placed by the agency.
Select Nannies is not responsible for the workplace safety of candidates referred to Clients. Clients are strongly advised to have Domestic Employees Workers compensation Insurance cover. Select Nannies is not responsible for any damage or breakage, which occurs when candidates referred by the agency, are on the clients premises. Accidents can happen and the Agency recommends that all household items (especially valuables) be covered by the Clients household Contents Insurance.
- Privacy
The Client agrees to allow Select Nannies to collect personal information about the Client, including information that is considered to be sensitive. The Client acknowledges that personal information collected by Select Nannies needs to be disclosed to third parties in order for Select Nannies to provide the Services and you consent to such disclosure.
- Replacement Guarantee
The Agency Booking fee is non refundable.
Select Nannies implements a four week trial period at the start of each placement. The 4 week trial periods starts from the first day of employment. If within this period either your self or the nanny that you have chosen is unhappy with the arrangement, the placement may be cancelled. In this event Select Nannies will endeavor to provide another suitable candidate free of charge. If however no suitable candidate can be found, you will be entitled to a 50% refund of your placement fee, providing that the fee has been paid in full by the due date.
If a Candidate who has been confirmed for an assignment with the Client either does not start employment, has their employment terminated (in writing) or leaves within 3 hours of starting employment with the Client then, we will endeavor to provide a suitable replacement candidate free of charge.
There will be no refunds given if any of the following happens:
The booking has been cancelled by the Candidate because of unreasonable demands by the Client and where the Client does not provide separate accommodation as agreed for an au pair
The Candidate has left because of unreasonable working conditions or because of a change in the job description or change in location
The client has changed their mind and does not want to employ anyone at all.
No refund will be given where the Client retains the services of the Candidate, even though the Client considers the Candidate unsatisfactory.
If the Agency placement fee was not paid in time
SELECT NANNIES RESERVES THE RIGHT TO REFUSE REPLACEMENT IF WE BELIEVE THAT THE CARER HAS BEEN HARASSED OR MISTREATED IN ANY WAY EMOTIONALLY, PHYSICALLY, OR MENTALLY.
In the event of any of the above the Au Pair/Mother’s Help/Nanny shall be entitled to terminate the engagement with immediate effect. Select Nannies will only make one (1) replacement per permanent placement. This will only apply if our account has been paid/ received by the due date.
In the event that a host Family decides to substantially change their duty hours and days without notifying Select Nannies after the Nanny/Au Pair has commenced her work, and if the understanding between the Host Family and the Nanny/Au Pair can not be resolved, a seven day notice will apply. Written notification by the Host Family is required.
- Governing Law
This Contract will be governed by and construed according to the laws of New South Wales. The parties submit to the exclusive jurisdiction of the courts of that state and waive any right to object to proceedings being brought in those courts or tribunals.
- Release and Indemnity
While Select Nannies uses its best efforts to satisfy itself that all potential permanent staff and babysitters it arranges for you are experienced, are over 18 years of age who have a recognised first aid certificate, are registered carers, fit to undertake childcare duties, do not have a police record and will be reliable. It does not accept any liability for any loss or injury suffered or incurred by you or any of your children or damage to you, any of your children or your property directly or indirectly resulting from carrying out any duties under this agreement and you agree to indemnify and keep indemnified Select Nannies with respect to any such loss or injury or damage whether or not caused directly or indirectly by any act, omission or negligence of Select Nannies of any of its agents. This release and indemnity continues forever.
- Our Fees
The Agency booking fee is payable prior to us arranging an interview with one of our suitable candidates. The Placement Fees are payable by the client on the acceptance, either verbally or in writing by a candidate of a position with the Client. It is the responsibility of the Client to notify the Agency if a Candidate has been offered employment.Placement Fees, at the current rate of the Agency’s charges are payable a day before the candidate starts work. The client understands our Agency Booking and Placement fees are non-transferable. The client is liable to pay the Nanny for their work every week for permanent nanny/ au pair bookings. The agency reserves the right to increase the fees by giving one month's written notice to the client. If the client is dissatisfied with the increase he or she may cancel the contract. In such an event the client shall no longer be entitled to employ the service of the Nanny on any basis.
The client agrees to notify the agency of a reengagement or extension of temporary engagement
PAYMENT OF ACCOUNTS
The methods of payment you can use are:

- Send us an email authorizing us to charge your credit card with the following details:
Credit Card number, name on the credit card, expiry date and 3 digits at the back of the card.
All payments between the client and the agency are to be confidential and can not be discussed with the Nanny/Babysitter or Au Pair.
LATE PAYMENT SERVICE CHARGE
There is late payment fee of $50 if invoice payment is not received within 5 days of the date of the invoice, Select Nannies will levy a further fee of $50 after 14 days.
DISCLAIMER
The management of Select Nannies reserves the right of offering its services to Applicants and Host Families. The management of Select Nannies reserves the right to change its fees at any time. Your relationship with Select Nannies is one of principal and agent. Nothing in this agreement is intended to create a relationship of employer and employee between you and Select Nannies either generally or in relation to any one or more of your obligations under this agreement or a relationship of principal and contractor.
We accept the above terms and conditions and will abide by the payment instructions provided.
The Agency reserves the right to use its own discretion with regard to any situation or problem not itemised in its terms.
